Mediation

A Divorce Mediator is a neutral divorce specialist who is jointly retained by you and your spouse to guide careful, peaceful, settlement negotiations. A Mediator does not align with either client’s position, rather uses the culmination of their experience to present a distinctly new alternative position that will work for each client to resolve their issues. A mediator does not provide independent legal counsel to either spouse, though we certainly apply insights gained from litigation experience to help our client’s create sustainable solutions. The entire mediation process is conducted outside of court and agreements that culminate from Mediation will be drafted by our experienced staff, filed with the court, and become binding as would any Judgement.

Mediation allows you and your spouse to learn about variety of legal options in a low stress environment, providing you the agency to create solutions tailored to your unique circumstances.

You and/or your spouse may elect, but are not required to, retain independent legal counsel to advise you throughout the process and/or review the final agreement before it becomes enforceable.

Collaborative Divorce

Collaborative Divorce is a team approach to non-litigated divorce settlement where each spouse has their own attorney who is equally committed to resolving their matter outside of Court. The traditional Collaborative Law approach uses jointly retained financial and mental health-based family neutral team members to provide support and advise throughout the divorce process. Your Collaborative Attorney is bound by an agreement which prevents them from representing you in court should negotiations fail, which means everyone is equally bound and determined to settle your matter outside of court.

Independent Review Counsel

Parties to mediation often obtain independent legal counsel and support throughout the mediation process. Independent legal counsel will prepare you prior to and throughout the mediation process by providing you privileged legal consultation and advice as to your rights and obligations and help formulate negotiation strategies to provide for optimal results from mediation.

Your attorney can either attend mediations with you, or advise from the sidelines. Either way, you have an experienced attorney whose sole purpose is to look out for you, so you can breathe easier and focus on a peaceful resolution.
